1. Who we are
This website, emhauto.com (the "Site"), is operated by EMH AUTO (PTY) LTD (registration number 2025/747691/07), a company registered in South Africa with its registered address at 97 Coronation Road, Malvern, Durban, KwaZulu-Natal, 4005 ("EMH Auto", "we", "us"). These Terms of Service ("Terms") govern your use of the Site and all purchases made through it. By using the Site or placing an order you agree to these Terms and to our Privacy Policy, Shipping Policy and Refund Policy, which form part of these Terms.
2. Eligibility
By using the Site you confirm that you are at least 18 years old or have the consent of a parent or guardian, and that the information you provide to us is accurate and complete.
3. Our products
EMH Auto is an independent South African reseller of genuine automotive care and maintenance products, sourced through the brands' official South African distribution channels. Brand names such as Meguiar's, Rislone and Carways are the trademarks of their respective owners and are used only to identify the genuine products we sell; EMH Auto is not the manufacturer of these products and does not claim any affiliation beyond resale of genuine stock. We take care to represent products accurately, but colours and packaging may differ slightly from images due to screen settings or manufacturer updates.
4. Orders
Placing an order is an offer to purchase. An order is accepted only when we confirm acceptance after your payment has been received and has cleared. We may decline or cancel an order where a product is unavailable, where there is an obvious pricing or listing error, or where we suspect fraud; in that case any amount paid will be refunded in full. If an order is cancelled or changed, we will contact you using the details provided at checkout.
5. Pricing and payment
All prices are shown in South African Rand (ZAR) and are final — the price displayed for a product is the price you pay for it, plus the delivery fee calculated at checkout. EMH AUTO (PTY) LTD is not currently registered for VAT and therefore no VAT is charged or added at checkout. We accept the payment methods displayed at checkout. For EFT/bank deposit payments, our banking details are provided with your order confirmation; orders are processed once the funds reflect in our account (typically 1–2 business days).
6. Shipping and delivery
We currently deliver within South Africa only. Processing and delivery timeframes, and how delivery fees are calculated, are set out in our Shipping Policy. Delivery timeframes are estimates; risk in the products passes to you on delivery.
7. Returns and refunds
Returns, exchanges and refunds are handled in accordance with our Refund Policy. Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.
8. Intellectual property
The content of the Site, including our name, logo, text and layout, belongs to EMH Auto or its licensors. Product images, brand names and logos belong to the respective brand owners and are used to identify genuine products offered for resale. You may not reproduce Site content for commercial purposes without written permission.
9. Our platform
The Site is hosted on Shopify, which provides the e-commerce platform that allows us to sell to you. All sales made on the Site are made directly between you and EMH AUTO (PTY) LTD; Shopify is not a party to, and is not responsible for, any sale.
10. Liability
To the extent permitted by law, EMH Auto is not liable for indirect or consequential loss arising from the use of the Site or products purchased on it. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, or any of your rights under the Consumer Protection Act. Always read and follow the manufacturer's instructions and safety information supplied with each product.
11. Governing law
These Terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts.
12. Changes to these Terms
We may update these Terms from time to time by posting the revised version on this page. The version displayed at the time you place an order applies to that order.
